What Is the CVS Digital Privacy Settlement About?
The case is Brewer, et al. v. CVS Pharmacy, Inc. and Criteo Corp., Case No. CACE-26-008094, in the Circuit Court for the 17th Judicial Circuit in and for Broward County, Florida. Plaintiffs alleged that tracking technology embedded on CVS digital properties disclosed users' health information, browsing data and identifiers to Criteo and other third parties.
The complaint asserted claims under the federal Electronic Communications Privacy Act and state privacy laws. CVS and Criteo deny wrongdoing and agreed to the $20.5 million fund to avoid the cost of further litigation. Notices went out by email in September 2026.
Who Is Eligible?
You may be a class member if you accessed any CVS digital property in the United States before July 27, 2026. That includes cvs.com, cvshealth.com and the CVS mobile app. A purchase is not required, but an in-store visit alone does not count.
Only one claim is allowed per household, meaning everyone living at the same mailing address shares a single claim.
