Johnson & Johnson Consumer Inc. - the company behind Neutrogena - has agreed to pay $4.7 million to resolve a class action lawsuit alleging it violated Illinois' Biometric Information Privacy Act (BIPA). If you used the Skin360 skin assessment app while in Illinois during the covered period, you may be entitled to a cash payment. The deadline to file is November 25, 2026.
What Is This Settlement About?
Skin360 is an app-based skin assessment tool that uses a smartphone camera to analyze a user's skin texture, pores, and hydration. Versions were offered under multiple brand names including Neutrogena Skin360, NeoStrata Skin360, and collaborations with other entities.
The lawsuit, Melzer v. Johnson & Johnson Consumer Inc., was filed in the United States District Court for the District of New Jersey (Case No. 3:22-CV-03149-MAS-RLS). Plaintiffs alleged that Johnson & Johnson collected, stored, and profited from users' facial geometry data - a biometric identifier - without obtaining the written consent required under Illinois law. They further alleged the company failed to publish a publicly available written policy governing data retention and destruction, as BIPA mandates.
Johnson & Johnson, now operating as Kenvue Brands LLC, denied all allegations and the court made no ruling on the merits. Both parties agreed to settle to avoid the uncertainty and expense of continued litigation.
Who Is Eligible?
You may be eligible if you:
- Were physically located in Illinois (residency is not required, but use outside Illinois does not qualify)
- Used any version of Skin360 - including Neutrogena Skin360, NeoStrata Skin360, or a Skin360 collaboration - through a mobile or web application
- Performed at least one skin assessment between December 9, 2019 and May 5, 2023
- Are 18 years of age or older
Current Illinois residency is not required. If you used the app while in Illinois during travel or while living there at the time, you may qualify.
How Much Will You Get?
Each eligible claimant who submits a valid claim will receive an equal pro-rata share of the net settlement fund. The $4.7 million total will be reduced by court-approved attorneys' fees (up to one-third of the fund), up to $5,000 in service payments for each of the four class representatives, and settlement administration costs. The remainder is split equally among all valid claimants.
The exact payment per person is not yet known and will depend on the total number of valid claims submitted. Past BIPA settlements involving biometric data have resulted in payments ranging from roughly $23 to several hundred dollars per claimant.
